Comment | Hi, I know that Leo is not a legal forum, but I am hoping that this question is so obvious and second nature for people who grew up in Germany that someone here can help me.
Is there an official list of what constitutes a wichtiger Grund that someone can point me to? Would "moving out of country" in and of itself be enough, or does it still depend on why you are moving?
(Background story - I am pretty sure that I read in the local paper once that moving to somewhere where service wasn't provided, i.e., another country, was reason to cancel a contract. In late June, Deutsche Telekom called me and tried to drop the price of the package I currently have, but said it would require a 24-month minimum contract. I already am trying to figure out how I will ever find a date when my Kündigungsfrist, that of my husband, the newspaper subscription, the telephone, the apartment, etc all come together - How do people do this? - Anyway, I told the girl on the phone that I would only agree to it if she promised me that I could break the contract if I moved to the US, and she said that she couldn't confirm that, but I was sure I had read it and so I agreed.
I instantly felt buyer's remorse, and so after trying for a week or so to pull up a record of this order on t-com.de, just before the 14-day Widerrufsfrist expired, I wrote them a letter saying I wanted to cancel. I heard nothing back from them, but this week I got a letter saying that my Auftrag (now dated, in their opinion, 01.08.07) was bestätigt, and that it would go into effect immediately, but that I now have 14 days from reception of the letter to cancel it.)
Appreciate any advice, but prefer a link to written codification of my rights, because 15 years ago when I left Frankfurt I had to pay some fine to DT in order to get out of a contract that the previous renter of my apartment had signed over to me and still hadn't reached the end of its run, and I would rather pay the extra 5 Euros a month than have to pay an extra year of this contract if I decide not to stay here.

(PS - How can it take so long for them to process the order for a billing change, how did they manage to ignore my previous Widerruf, and can they really confirm and start the service before telling me about it and starting my 14-day period? Or do they actually have to, because I am supposed to get to try it out for 14-days, not just read the contract?) |
