"Tatsachen" ist aus meiner Sicht nicht gemeint, eher das "gefühlte" Image eines Mitgliedsstaates, das, was er sich "verdient" hat im Rahmen seines gemeinschaftlichen Engagements.
Das kommt in der Tat häufig in Kontrast zu dem gesetzmäßig Vereinbarten.

Hm, aber das passt nicht. Der Text geht weiter mit: "We all recognize that the wisdom of a policy is not for the court or Council of State and yet we all recognize that outrageous decisions must be susceptible to some sort of control. So we all face the difficulty of identifying the degree of control which is appropriate." Dann listet der Autor einige denkbare Rechtswidrigkeitsgründe (z.B. Unverhältnismäßigkeit) auf. Ich denke, das hat schon was mit Rechtmäßigkeit und eben "merits" (doch Tatsachen? tatsächliche Gründe?) zu tun.

By “merits”, I think the author means principles of equity or fairness, or, to use a well-known phrase, “the merits of the case”. This sometimes comes into conflict with “legality”, i.e. a strict interpretation of the law. Judges are obliged to stick to the law as it stands; this occasionally requires them to make decisions which seem perverse.
