"In KHS AG v. Schulte
(Case C 214/10) IRLR 156 the worker, who had suffered a heart attack, was away sick for number of years until the termination of his employment. A collective agreement that applied to his contract of employment provided that, if leave could not be taken because of illness, entitlement to that leave would lapse fifteen months after the end of the reference period."
"Individual approaches and relationships could be incredibly supportive, or cause a major problem. Therefore it was important that those away sick had access to others, apart from their line manager, to ensure a positive experience."
"In the past, it was possible to recover some statutory sick pay if you had a high proportion of employees away sick at the same time, under the Percentage Threshold Scheme."
'Mr Stanyer said: "Our position is that employees, including those on maternity, should not accrue leave when away sick, a stand that I think many of their colleagues, who usually have to provide cover during sickness absence and holidays, would agree with.
"Employment law in general is far too complex and sometimes impossibly vague on important detail."'
"In his letter to Betty of the 29th, Gerry wrote: "This is a very good battalion, I think, and I'm not a bit sorry I came now. I am taking over command of a company, only for the time being, as the captain thereof is away sick." Despite the positive impression of his new unit, he keenly sought a transfer back to the 1st Battalion which was in billets only 1½ miles (2.5km) away at Bertrancourt."
