nicht korrekt. Das würde ja nur passen, wenn sich ein Richter selbst befangen erklärt, nicht aber, wenn von außen - wie ich den OP auch verstehe - beantragt wird, ihn für befangen zu erklären.

Das entbehrt jedenfalls einer gewissen Logik. Ebenso wie Zitate als Beweise anzuführen, die zumindest fragwürdig sind.

Nur weil es schon im Wörterbuch steht, beweist jedenfalls nicht, dass es richtig ist. Um es mit Sicherheit als falsch melden zu können, würde es aber eines ENS-Juristen bedürfen, der aufklärt, wie der exakte Gebrauch ist, denn aus dem Zusammenhang gerissene Zitate, bei denen man die genaue Situation nicht kennt, können immer unterschiedlich interpretiert werden.

Nur, um die Situation ein wenig zu verkomplizieren:
